The clearing requirements have led to significant changes in derivatives documentation. While unsettled derivatives continue to be governed by a master`s contract from the International Swaps and Derivatives Association (ISDA) and an annex to credit assistance, offset derivatives require other documents such as: (i) clearing agreements, (ii) clearing agreements and (iii) collateral transformation agreements. This webinar discussed the recently released FIA-ISDA Cleared Derivatives Execution Agreement – a model that can be used by participants in clear swap markets to negotiate enforcement-related agreements with over-the-counter derivatives counterparties that must be removed.
